By accessing or using KitSort (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

KitSort is a mobile application that helps hobbyists catalog, recognize, and share their collections — including scale models, diecast vehicles, LEGO sets, and DIY electronics.

What you provide: Photos, descriptions, and metadata about items in your collection.

What you receive: An organized digital catalog of your collection with recognition, search, and sharing capabilities.

Important: This is a digital service. All processing occurs online. The Service is provided for personal hobby use and is not guaranteed to be accurate, complete, or suitable for any specific commercial purpose.

Account Creation

To use certain features of the Service, you must create an account. When you create an account, you must provide accurate, complete, and current information.

Account Security

You are responsible for safeguarding the password you use to access the Service and for any activities or actions under your account. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Account Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

Some parts of the Service are billed on a subscription basis. You will be billed in advance on a recurring and periodic basis (such as monthly or annually). Lifetime plans are billed as a one-time payment.

Billing

Billing cycles are set on a regular basis, typically monthly or annually. At the end of each billing cycle, your subscription will automatically renew unless you cancel it or we terminate it.

Cancellation

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period. You will not receive a refund for the current billing period.

Refunds

We offer a 30-day money-back guarantee for first-time subscribers. If you're not satisfied with the Service within the first 30 days, contact us for a full refund.

Price Changes

We reserve the right to modify our pricing at any time. We will provide you with reasonable notice of any pricing changes. Your continued use of the Service after the price change constitutes your agreement to pay the modified price.

The Service and its original content, features, and functionality are and will remain the exclusive property of KitSort and its licensors. The Service is protected by copyright, trademark, and other laws.

When you submit photos, descriptions, or other content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and analyze this information to provide and improve the Service.

You represent and warrant that you have the right to submit any content you provide and that such content does not violate any third-party rights or applicable laws.

9. Your Data

Your collection data belongs to you. You may export it at any time, free of charge. We do not claim ownership of any content you create or catalog within the app.

10. Disclaimers and Limitations

“As Is” Service

The Service is provided on an “AS IS” and “AS AVAILABLE” basis. We make no warranties, expressed or implied, regarding the Service, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

No Guarantee of Accuracy

While we strive to provide accurate recognition and cataloging features, we cannot guarantee the accuracy, completeness, or timeliness of the information generated by the Service. OCR and recognition results should be verified by the user.

Limitation of Liability

To the maximum extent permitted by law, KitSort shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

11. Indemnification

You agree to indemnify, defend, and hold harmless KitSort and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Service, or your violation of these Terms.

12. Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of Poland.

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Warsaw, Poland.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. We will provide notice of any material changes by posting the new Terms on this page and updating the “Last updated” date.

Your continued use of the Service after any changes become effective constitutes your acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the Service.

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
